1) INTRODUCTION
The purpose of this document is to establish and regulate the standards for the use of and to safeguard the data contained in the website www.hostal-victoria.com (henceforth the Website). The Website is understood to comprise all the pages and content owned by HOSTALES VICTORIA accessed via the domain www. hostal-victoria.com and its sub-domains. The owner of this Website is HOSTALES VICTORIA, with registered address calle Carretas 7, Madrid, and electronic mail address info@hostal-victoria.com (henceforth HOSTALES VICTORIA).
HOSTALES VICTORIA uses the Website to provide information, room reservation, employment search and any other services that it considers necessary for the correct execution of its corporate purposes.
These general conditions regulate the use of the Website service that HOSTALES VICTORIA makes available to users of the Internet. The use of the Website implies the full acceptance, without reservations, by the person using it (henceforth the User) of each and all of the General Conditions contained in the version published by HOSTALES VICTORIA at the time the Website is accessed by the User, who must therefore be aware of the importance of reading them each time he/she visits the Website. The action of accessing this Website implies knowledge and acceptance of the following General Conditions. HOSTALES VICTORIA therefore recommends that the User print or download them and read them carefully each time he/she accesses the Website. The use of the Service is also subject to any warnings, rules of usage and instructions given to the User by HOSTALES VICTORIA in addition to those included in these General Conditions insofar as the User does not object to them.
2) USE OF HOSTALES VICTORIA' ON LINE RESERVATION SERVICES
2.1) Online Reservation Services
The purpose of these services is to enable customers to reserve rooms in any DERBY hotel. The use of these services implies the full acceptance, without reservation and agreement to each and all of the general conditions contained in the most recent version of these general conditions.
2.1.2) Contract Conditions
The User, on using this service, will receive a confirmation e-mail containing a booking reference for the reservation. This e-mail serves as proof of the reservation and confirmation of its acceptance.
2.1.3) Guarantee and cancellation policy
The reservations made through this page are guaranteed against the credit card, details of which the User has provided in the form. If the customer does not check in or cancels with less than the minimum notice period required (24 hours), one night's accommodation will be charged to the credit card and the reservation will be cancelled. To cancel a reservation the customer may call the hotel directly 7 days a week.
2.2) USE OF THE SERVICES
The User agrees to use the services in accordance with the precepts of legality, morality, accepted custom and public order and in accordance with these General Contract Conditions. The User may not, therefore, use the services for any purpose that is illegal and/or contrary to that established in these General Contract Conditions, which harms the rights or interests of a third party in any way, or which may in any way damage the services, HOSTALES VICTORIA, and/or its image, or hinder the correct functioning of the services that it offers or may offer in the future.
3) SCOPE OF THE SITE. RESPONSIBILITY OF THE USER
The User is exclusively responsible for accessing the Website. The User assumes entirely and exclusively all risks which may be associated with the use of the Website. HOSTALES VICTORIA provides no guarantee with respect to the following: the reliability, availability, continuity, absence of faults and security of the Website; that the contents of the Website and any information transferred via the Website is free of viruses or other harmful items; that the use made by the User of the Website is secure.
HOSTALES VICTORIA accepts no responsibility for any damage or harm derived from any interference, omission, interruption, computer virus, telephone service failure or disconnection affecting the operation of this electronic system that occurs as a result of causes beyond the control of HOSTALES VICTORIA; for any delays or blockages in the use of this electronic system due to deficiencies or overloads in its Data Processing Centre, telephone lines, the Internet system or other electronic systems; or for any damage caused by third parties illegally entering the system beyond the control of HOSTALES VICTORIA.
Accessing the Website does not imply any commercial relationship between HOSTALES VICTORIA and the User.
4) CONTENTS
HOSTALES VICTORIA reserves the right to prevent or prohibit access to the Website by any User who enters any information on the Website that contravenes the law or which is immoral, reserving the right to take such legal action as it considers appropriate to prevent such conduct.
5) DATA PROTECTION
The User of the services offered through this Website provides personal details voluntarily and expressly and fully accepts, without reservation, that HOSTALES VICTORIA may automatically process these details and store them in an electronic file for the purposes of providing and offering its services. HOSTALES VICTORIA is responsible for this file, which has been registered on the General Register of the Data Protection Agency.
Due to the nature of HOSTALES VICTORIA' business and the services it provides, and to ensure its corporate purpose is correctly pursued, it needs to communicate personal details to third parties. The User is obliged to use the Website diligently, correctly and legally and, in particular, undertakes not to:
a) Suppress, conceal or manipulate the copyright notice, brands or other data which identify the rights of their owners (HOSTALES VICTORIA or any third party) forming part of the contents and/or products sold through the Website or any technical devices to protect data, digital fingerprints or other data mechanisms they may contain.
